I. Introduction

Please read these Terms and Conditions (‘Terms’, ‘Terms and Conditions’) carefully before using the EYP Member Platform operated by/maintained by the Schwarzkopf Foundation (‘SF’, ‘we’) and its programme, the European Youth Parliament (‘EYP’). The Schwarzkopf Foundation is the international umbrella organisation of the European Youth Parliament.

Your access to and use of the Member Platform (or ‘Platform’) is conditioned on your acceptance of and compliance with these Terms. They apply to users with an account on the Member Platform.

Upon creating an account to the Member Platform, you are asked to confirm your agreement with these Terms.

By accessing or using the Member Platform, you agree to be bound by these Terms.

If you have any questions about the terms, please get in touch with us via support@eyp.org. If you disagree with any part of the terms, please do not use the Platform and delete your account.

II. Fundamental

The European Youth Parliament is a unique educational programme which brings together young people from all over Europe. Thousands of young people are active as volunteers across the continent, making EYP a programme for young people, by young people. EYP’s mission is to inspire and empower young Europeans to become open-minded, tolerant and active citizens. All members of EYP are required to use the Member Platform in a way that is consistent and appropriate with the mission and values of the organisation: independence, non-partisanship, democracy, inclusion, empowerment, contribution, cooperation, pluralism, intercultural understanding.

As such, all account holders shall refrain from any activity (including, but not limited to, messages, posts, applications, evaluations, creating events, profiles or applications) on the Member Platform that :

Account holders must not convey any personal data of other account holders displayed on the Platform to third parties (individuals or entities without an account on the Platform). Failure to respect this can lead to immediate suspension of one’s account.

By using the Platform and accepting these Terms, you also agree not to misuse the Platform.

III. Registration for Events

The EYP is committed to ensuring that your privacy is protected. We request, store and process your data according to our Privacy Policy for the Member Platform - you can read it in full here: https://members.eyp.org/privacy-policy.

In a nutshell, we guarantee we will not sell, distribute or lease your personal information to third parties unless we have your explicit consent or are required by law to do so.

Please note that events you attend (that you register for and/or apply for and are accepted) will be displayed in your session history with the following information: name of event (with hyperlink to event’s page on the Platform), dates, type of event, country it took place and role you attended in. If you do not wish for this information to be displayed on your profile, please do not register for the event or contact the NOC to request deletion of your registration.

The answers you submit to the questions included in an application for an event, as well as your event history, evaluations received and any comment you submitted to said evaluations, are available to Selection Panels of the respective event. The author of an evaluation maintains access to your evaluation until it is deleted from the Platform.

IV. Selection panels, events, applications and evaluations

Whenever a user asserts the role of member of selection panels, NOC, IO staff or any other role with access to data of applicants and event participants, the user commits to treating such data with the utmost care. Users must not, under any circumstance, share the data, in full, extracts or rephrased, beyond the scope that applicants/participants have agreed to, nor to any other third parties (be it to other account holders or individuals/entities external to the Platform). Failure to respect this obligation can lead to immediate suspension of the user’s account for a duration to be determined on a case-by-case situation.

Evaluations submitted in bad faith, beyond the scope of an event or beyond one’s responsibilities in the event, are forbidden, going against the aim of EYP to provide learning experiences to participants. Users can report such actions and, after the required verifications, the IO will delete the evaluation. NCs will be invited to consider actions to take considering the individual in cause. The IO and Governing Body will also consider the appropriate further action to be taken on a case-by-case basis.

Users also commit to respect the confidentiality of applications and evaluations they are privy to (be it through submitting them or accessing them during selection panels or any other manner). Users cannot share or distribute applications and evaluations of individuals, in full or in part, beyond the members of the selection panel and beyond the timeframe for the selection process. Individuals must destroy any such material, whether in virtual or hard copy, once the selection process has ended and any post-application feedback has been given.

NC managers (for national events) and the IO staff (for international events) are responsible to remove access of individuals to selection panel or event data after the selection/event has passed and any post-event responsibilities have been accomplished. Applications to events are to be deleted by the IO team in one year after the submission.at the end of every year by NC managers for all events. Evaluations are deleted by the IO team once they become invalid (after four years).

The handling of all data on the Platform (events, applications, documents of any sort) is to be done in good faith, in an impartial, fair and honest manner. In case of questions as to the right procedure to follow, please contact us via support@eyp.org.

Any misuse of data shall be reported immediately to support@eyp.org.

V. Scope of application

  1. The following conditions apply to the use of our platform. For the use of the platform it is important that you as a user accept the following rules and conditions. Registration and use of our platform is free of charge.
  2. By registering, you agree to the terms of use of our platform. By agreeing, you warrant to us that you will not post anything that violates the terms of use.

VI. Duties as a user

(1) One of your obligations as a user is that you do not publish any contributions that violate these rules, offend common decency or otherwise violate applicable German law.

You are not permitted to do the following:

  1. publishing content that is untrue and the publication of which constitutes a criminal offence or an administrative offence,
  2. sending spam to other users via the platform,
  3. using content protected by copyright and trademark law without lawful authorisation (e.g. press releases etc.),
  4. actions that are anti-competitive,
  5. multiple posting of topics on the platform (so-called double postings),
  6. to carry out their own advertising, i.e. surreptitious advertising, and
  7. publish content that is offensive, racist, discriminatory or pornographic towards other users and the general public.

It is your duty as a user/forum user to refer to § 2 para. 1 nos. 1-7 of these terms of use before publishing your contribution and to check whether you have adhered to these points.

Should you violate § 2 para. 1 nos. 1-7 of these Terms of Use, we reserve the right to take the following steps against you:

  1. delete your posted contributions and modify them,
  2. prohibit you from continuing to post on the platform, and
  3. blocking your access as a user.

If you, as a user/forum user, have not observed the rules and if possible legal violations have arisen as a result of your posted content on our platform (breach of duty), you, as a user/forum user, undertake to indemnify us against any claims, including claims for damages, and to reimburse us for the costs incurred.

In addition, the user is obligated to support us in the event of claims for damages with regard to the defence of the legal violation caused by him/her (breach of duty, see above) and to bear the costs of an appropriate legal defence on our behalf.

(4) By your consent, you guarantee us that you will not create any amounts that violate the Terms of Use. The same applies to the setting of external links and the signatures.

VIII. Transfer of rights of use

You, as the user, are solely responsible for the copyright as defined by the Copyright Act when publishing contributions and topics on the platform. As a user, you only grant us the right to make the contribution permanently available for retrieval upon publication of your contribution.

Furthermore, our team has the right to delete, edit and move your topics and contributions within the platform in order to link them to other content or to close them.

IX. Limitation of liability

(1) We do not assume any liability for the contributions, topics, external links and the resulting content published and posted on the platform, in particular not for their correctness, completeness and topicality. We are also not obliged to permanently monitor the transmitted and stored contributions of users or to investigate whether they indicate illegal content. In principle, we are only liable in the event of an intentional or grossly negligent breach of duty.

(2) We expressly point out that the contributions and discussions of the users on the platform are completely non-binding. The use of the contributions and their exploitation is at your own risk.

(3) We do not guarantee a continuous uninterrupted access to the website. Any liability in this respect is hereby expressly excluded. Even with great care, downtimes can unfortunately not be excluded.

X. Liability

(1) We shall be liable to you in all cases of contractual and non-contractual liability in the event of intent and gross negligence in accordance with the statutory provisions for damages or reimbursement of futile expenses.

(2) In other cases, we shall only be liable - unless otherwise stipulated in para. 3 - in the event of a breach of a contractual obligation, the fulfilment of which is a prerequisite for the proper performance of the contract and on the observance of which you as a customer may regularly rely (so-called cardinal obligation), and this shall be limited to compensation for the foreseeable and typical damage. In all other cases, our liability is excluded subject to the provision in para. 3.

(3) Our liability for damages arising from injury to life, limb or health shall remain unaffected by the above limitations and exclusions of liability.

XI. Copyright

All texts, images and other information and data published on our website are - unless otherwise indicated - subject to the copyright of our site. Any form of reproduction and/or modification may only be made with our written permission. Otherwise we reserve the right to take legal action against such infringement. All costs caused by a violation of rights on the part of a user will be charged to the user.

XII. Termination and duration of membership

The duration of the membership begins with the registration and with the acceptance of our terms of use and exists for an indefinite period. The membership can be terminated at any time without notice.

In the event of the death of a member, the personal data will be deleted after notification.

We may terminate or suspend your access to the Member Platform immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, for breach of the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions and limitations of liability.

XIII. Reservation of the right to change

We have the right to change the terms of use at any time. The change will then be published via platform entry on the website. If a revision is material, we will try to provide at least 30 days notice prior to any change taking effect. We reserve the right to determine what constitutes a material change.

XIV. Jurisdiction

The law of the Federal Republic of Germany shall apply. If you have acted as a consumer and have your habitual residence in another country at the time of your membership, the application of mandatory legal provisions of that country remains unaffected by the choice of law made in sentence 1.
